Complications from using da Vinci robots for invasive surgeries

Categories:Defective Drugs and Products

Many health care providers in and around Tampa, Florida are turning to robots to perform complicated surgeries. Gynecologists, for example, are using robots to remove fibroid tumors and to remove the uterus (hysterectomy surgery). Robots use computer technology to give the doctors finer control over the procedure. Using a small opening, the technology and 3-D cameras are inserted into the patient. A console enlarges the view of the patient and precise controls let the physician operate. The benefits are not just for the doctor (finer control) but also for the patient. Robotic surgery can mean shorter recovery time, less risk of infection and less hospital time.

One type of robot, the da Vinci Robot, is being used for a variety of invasive procedures including gastric bypass surgery, bladder surgery, thyroid cancer, prostate problems – in addition to gynecology surgery. Even heart surgeons are using da Vinci robotic surgery. Intuitive Surgical, based in California, is the manufacturer of the da Vinci robot.

Complications with the da Vinci Robot

There have been many problems with da Vinci Robotic surgery including organ damage, abnormal bleeding, surgical burns, tears and cuts, and even deaths. Complaints have been filed with the US Food and Drug Administration.

Who is Responsible?

Lawsuits against Intuitive Surgical have started claiming that:

  • The product is defective;
  • Intuitive Surgical failed to properly train doctors and hospitals in the use of the device
  • Intuitive Surgical over-promised what the product could do.

Additional possible defendants include marketing companies for the da Vinci Robot, hospitals and doctors who used the device improperly or who weren’t properly trained and training companies.

When can lawsuits be started

Florida has statute of limitations laws the dictate when claims can be filed. Lawsuits for da Vinci robotic injuries should be filed as soon as possible.
