Your rights if you slip and fall in a Target store in Tampa, Florida

Target has over a hundred stores, many of them in the Tampa, Florida area. While people can shop online, most customers love to shop in the store.  Whether it’s buying fresh groceries, trying on clothes or carrying out big ticket items like furniture or TVs; customers like to be in the Target store. But when customers are in their favorite Target store, there is always the danger the customer can slip and fall and severely injure themselves.

Duty of care factors: Target owes several duties of care to their customers.

  • They must keep their stores in a reasonable safe condition
  • They must warn customers of dangers that the customer can’t reasonably anticipate.
  • Florida law now requires that a plaintiff show that Target know or should have known of the dangerous condition.
  • The Target store is in the best position to routinely inspect the store and to routinely respond to complaints or warnings about dangerous conditions.

If you slip and fall in a Target store you need to address your physical problems by notifying Target management and you should see your family physician as soon as you can. You should also take steps to make sure you can show Target failed in its duty of care – that they failed to take reasonable steps.

  • Determine if the conditions indicate that the problem was old.
    • Constructive knowledge. Do the conditions around the scene of the fall indicate the store should have been aware of the danger? Look around to see if:
      • The substance or merchandise that caused the fall was clear or dirty.
      • There were any tread-marks.
      • There were indications of store traffic around the site
      • There was a store employee nearby
      • Lighting was like was sufficient.
      • The tile or carpet surface were proper.
      • There were any warning signs?
